With the rising cost of living, a deduction in the MTD can be a great help for employees. It is important to note that it is the Employer&#8217;s responsibility to get familiarize with the rules and regulations before making any deductions. Here&#8217;s a rundown of the forms to get yourself acquainted.\u00a0\u00a0 <\/span><\/p><p>\u00a0<\/p><p id=\"viewer-2l54u\" class=\"XzvDs _208Ie _247b9 _2QAo- _25MYV eaHbJ _247b9 public-DraftStyleDefault-block-depth0 public-DraftStyleDefault-text-ltr\"><span class=\"vkIF2 public-DraftStyleDefault-ltr\"><strong>1. Form PCB TP1 for Individuals<\/strong> <\/span><\/p><p id=\"viewer-qs5i\" class=\"XzvDs _208Ie _247b9 _2QAo- _25MYV eaHbJ _247b9 public-DraftStyleDefault-block-depth0 public-DraftStyleDefault-text-ltr\"><span class=\"vkIF2 public-DraftStyleDefault-ltr\">TP1 Form is likely the most commonly used as it allows deductions from common tax reliefs for individuals. It includes insurance, books, education and more. Form PCB TP2 for Benefits-in-Kind and Value-of-Living Accommodation Provided by the Employer<\/strong> <\/span><\/p><p id=\"viewer-61gdv\" class=\"XzvDs _208Ie _247b9 _2QAo- _25MYV eaHbJ _247b9 public-DraftStyleDefault-block-depth0 public-DraftStyleDefault-text-ltr\"><span class=\"vkIF2 public-DraftStyleDefault-ltr\">The use of TP2 forms has been made compulsory since the year 2015. When an employee receives Benefits-in-Kind (BIK) such as Leave Passage, club membership or allowances, these need to be declared. More often than not, employees find that these benefits can often lead to a spike in the accumulated taxable amount, leading to a higher tax rate and the need for a CP38 deduction. Hence, making it compulsory ensures that chargeable income tax is computed sufficiently every month. <\/span><\/p><p id=\"viewer-esshc\" class=\"XzvDs _208Ie _247b9 _2QAo- _25MYV eaHbJ _247b9 public-DraftStyleDefault-block-depth0 public-DraftStyleDefault-text-ltr\"><span class=\"vkIF2 public-DraftStyleDefault-ltr\">The TP2 Form can be found <a class=\"_2qJYG _2E8wo\" href=\"http:\/\/lampiran1.hasil.gov.my\/pdf\/pdfborang\/TP22013.pdf\" target=\"_blank\" rel=\"noopener\"><u class=\"sDZYg\">here<\/u><\/a>.<\/span><\/p><div data-hook=\"rcv-block20\">\u00a0<\/div><p id=\"viewer-20h9r\" class=\"XzvDs _208Ie _247b9 _2QAo- _25MYV eaHbJ _247b9 public-DraftStyleDefault-block-depth0 public-DraftStyleDefault-text-ltr\"><span class=\"vkIF2 public-DraftStyleDefault-ltr\"><strong>3. Form PCB TP3 for Information Related to Employment with the Previous Employer\u00a0\u00a0<\/strong> <\/span><\/p><p id=\"viewer-4f8fo\" class=\"XzvDs _208Ie _247b9 _2QAo- _25MYV eaHbJ _247b9 public-DraftStyleDefault-block-depth0 public-DraftStyleDefault-text-ltr\"><span class=\"vkIF2 public-DraftStyleDefault-ltr\">To ensure a new employee&#8217;s income tax falls in the right tax bracket, the TP3 Form requires information about the employee&#8217;s previous employment remuneration and benefits. It is mandatory that each new hire fills up this Form to ensure the correct total taxable amount.<\/span><\/p><p id=\"viewer-3ovds\" class=\"XzvDs _208Ie _247b9 _2QAo- _25MYV eaHbJ _247b9 public-DraftStyleDefault-block-depth0 public-DraftStyleDefault-text-ltr\"><span class=\"vkIF2 public-DraftStyleDefault-ltr\">The TP3 Form can be found <a class=\"_2qJYG _2E8wo\" href=\"http:\/\/lampiran1.hasil.gov.my\/pdf\/pdfborang\/TP32013.pdf\" target=\"_blank\" rel=\"noopener\"><u class=\"sDZYg\">here<\/u><\/a>.<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3e291ef4 elementor-widget elementor-widget-heading\" data-id=\"3e291ef4\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Employers Responsibility  <\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3cd6194e elementor-widget elementor-widget-text-editor\" data-id=\"3cd6194e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p id=\"viewer-7aihg\" class=\"XzvDs _208Ie _247b9 _2QAo- _25MYV eaHbJ _247b9 public-DraftStyleDefault-block-depth0 public-DraftStyleDefault-text-ltr\"><span class=\"vkIF2 public-DraftStyleDefault-ltr\">There are seven responsibilities listed in the Income Tax (Deduction from Remuneration) (Amendment) Rules 2013. However, here\u2019s a simplified version. <\/span><\/p><ul class=\"public-DraftStyleDefault-ul\"><li id=\"viewer-2rrng\" class=\"_247b9 _1cCz9 _1BJwx public-DraftStyleDefault-unorderedListItem\n   public-DraftStyleDefault-depth0\n   public-DraftStyleDefault-list-ltr public-DraftStyleDefault-reset _2QAo- _25MYV eaHbJ _247b9\"><p class=\"_208Ie _2QAo- _25MYV eaHbJ _247b9\">Employers must make known to employees about the availability of Form TP1, TP2 and TP3 and ensure they understand how it affects their MTD&#8217;s.<\/p><\/li><li id=\"viewer-947qk\" class=\"_247b9 _1cCz9 _1BJwx public-DraftStyleDefault-unorderedListItem\n   public-DraftStyleDefault-depth0\n   public-DraftStyleDefault-list-ltr _2QAo- _25MYV eaHbJ _247b9\"><p class=\"_208Ie _2QAo- _25MYV eaHbJ _247b9\">Employers are allowed to have a minimum of 2 submission windows for the TP1 Form annually. However, employees must be made known of the set timeframe.\u00a0<\/p><\/li><li id=\"viewer-fs2eg\" class=\"_247b9 _1cCz9 _1BJwx public-DraftStyleDefault-unorderedListItem\n   public-DraftStyleDefault-depth0\n   public-DraftStyleDefault-list-ltr _2QAo- _25MYV eaHbJ _247b9\"><p class=\"_208Ie _2QAo- _25MYV eaHbJ _247b9\">Employers are to ensure the TP2 Form is processed for monthly tax deduction every time a BIK payment is made to employees.<\/p><\/li><li id=\"viewer-bpbve\" class=\"_247b9 _1cCz9 _1BJwx public-DraftStyleDefault-unorderedListItem\n   public-DraftStyleDefault-depth0\n   public-DraftStyleDefault-list-ltr _2QAo- _25MYV eaHbJ _247b9\"><p class=\"_208Ie _2QAo- _25MYV eaHbJ _247b9\">It is the employee&#8217;s responsibility to fill up the forms and ensure all information provided is accurate. There is no need to provide any supporting documents such as receipts.<\/p><\/li><li id=\"viewer-2njro\" class=\"_247b9 _1cCz9 _1BJwx public-DraftStyleDefault-unorderedListItem\n   public-DraftStyleDefault-depth0\n   public-DraftStyleDefault-list-ltr _2QAo- _25MYV eaHbJ _247b9\"><p class=\"_208Ie _2QAo- _25MYV eaHbJ _247b9\">The company must retain all TP1, TP2 and TP3 Forms for at least seven years.\u00a0<\/p><\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-326fc46d elementor-widget elementor-widget-heading\" data-id=\"326fc46d\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Penalties for Failure to Comply <\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2c3d08f2 elementor-widget elementor-widget-text-editor\" data-id=\"2c3d08f2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"yF0IC\" data-hook=\"post-description\"><article class=\"blog-post-page-font\"><div class=\"post-content__body\"><div class=\"_21Y0E\"><div class=\"_21Y0E\"><div class=\"f-0hV _15aM- _1VVYC\" data-rce-version=\"8.36.0\"><div class=\"kcuBq Qbjx- _3-ucy uatYj\" dir=\"ltr\" data-id=\"rich-content-viewer\"><div class=\"kaqlz _3suv7\"><p id=\"viewer-blsa7\" class=\"XzvDs _208Ie _247b9 _2QAo- _25MYV eaHbJ _247b9 public-DraftStyleDefault-block-depth0 public-DraftStyleDefault-text-ltr\"><span class=\"vkIF2 public-DraftStyleDefault-ltr\">An employer is liable for persecution under Rule 17, Income Tax (Deduction from Remuneration) Rules 1994 if &#8220;The Rules&#8221; for MTD do not comply. The type of offences includes the following.\u00a0 <\/span><\/p><div data-hook=\"rcv-block40\">\u00a0<\/div><ul class=\"public-DraftStyleDefault-ul\"><li id=\"viewer-9v1kr\" class=\"_247b9 _1cCz9 _1BJwx public-DraftStyleDefault-unorderedListItem public-DraftStyleDefault-depth0 public-DraftStyleDefault-list-ltr public-DraftStyleDefault-reset _2QAo- _25MYV eaHbJ _247b9\"><p class=\"_208Ie _2QAo- _25MYV eaHbJ _247b9\">Failure to remit Monthly Tax Deductions of employees by the 15th of the following month.<\/p><\/li><li id=\"viewer-faf60\" class=\"_247b9 _1cCz9 _1BJwx public-DraftStyleDefault-unorderedListItem public-DraftStyleDefault-depth0 public-DraftStyleDefault-list-ltr _2QAo- _25MYV eaHbJ _247b9\"><p class=\"_208Ie _2QAo- _25MYV eaHbJ _247b9\">Failure to pay and\/or reduce MTD and\/or make CP38 deductions from the employee&#8217;s remuneration.<\/p><\/li><li id=\"viewer-7gmk4\" class=\"_247b9 _1cCz9 _1BJwx public-DraftStyleDefault-unorderedListItem public-DraftStyleDefault-depth0 public-DraftStyleDefault-list-ltr _2QAo- _25MYV eaHbJ _247b9\"><p class=\"_208Ie _2QAo- _25MYV eaHbJ _247b9\">Failure to give complete and accurate information about employees.<\/p><\/li><li id=\"viewer-307i9\" class=\"_247b9 _1cCz9 _1BJwx public-DraftStyleDefault-unorderedListItem public-DraftStyleDefault-depth0 public-DraftStyleDefault-list-ltr _2QAo- _25MYV eaHbJ _247b9\"><p class=\"_208Ie _2QAo- _25MYV eaHbJ _247b9\">Under this Rule, upon conviction, an employer can be fined not less than RM200 and not more than RM20,000, imprisonment for a term not exceeding six months of both.<\/p><\/li><\/ul><div id=\"viewer-dqv4j\" class=\"XzvDs _208Ie _247b9 _2QAo- _25MYV eaHbJ _247b9 public-DraftStyleDefault-block-depth0 public-DraftStyleDefault-text-ltr\"><span class=\"vkIF2 public-DraftStyleDefault-ltr\">\u00a0<\/span><\/div><p id=\"viewer-819st\" class=\"XzvDs _208Ie _247b9 _2QAo- _25MYV eaHbJ _247b9 public-DraftStyleDefault-block-depth0 public-DraftStyleDefault-text-ltr\"><span class=\"vkIF2 public-DraftStyleDefault-ltr\">TP Forms are very much lesser-known amongst Malaysian employees today. However, the use of TP Forms is beneficial for all parties- employers, employees and the Inland Revenue Board of Malaysia.
